The Incoterms are a set of commercial/trade rules established by the International Chamber of Commerce (“ ICC ”) that are used in international sale contracts. [1] The Incoterms are not mandatory rules – for them to receive legal effect, they must be explicitly incorporated by the parties into their contract. WebAlthough the ICC recommends using Incoterms® 2024 beginning January 1, 2024, parties to a sales contracts can agree to use any version of Incoterms after that date. It is important, however, to clearly specify the chosen version of Incoterms being used (i.e., Incoterms® 2010, Incoterms® 2024, or any earlier version).
